The agreement between Art And Urn and the User, created under these Terms and Conditions, will terminate if the User deletes their registration or if Art And Urn deletes the User’s registration.

In addition to the rights explicitly defined in these T&C, the registration, use of the Website, or any provision of the T&C does not grant the User the right to use or exploit any commercial name or trademark appearing on the Website. PURCHASE IN THE WEB SHOP

3.1. Registration

A significant portion of the Website’s content is available to all Users without registration. However, some services require registration (and subsequent login).

The User can register by clicking the “Registration” menu on the Website or during the first order, where the following information is required by Art And Urn:

  • Email address
  • Password
  • Last name
  • First name
  • Phone number
  • Address (city, postal code, street name, house number, country)

Art And Urn will notify the User by email regarding the success of the registration.

The registered User will only need to log into their created registration account with their email address and password during future orders and will not need to enter their details again for each order.

The User is entitled to delete their registration at any time by logging into their user account and clicking the “DELETE MY ACCOUNT” button or sending an email to info@artandurn.com. After receiving the message, Art And Urn is obliged to promptly delete the registration. After deletion, the User’s data will be immediately removed from the system; however, this does not affect the retention of data and documents related to orders already placed, and the deletion of this data will not occur. After removal, the data cannot be restored.

The User is solely responsible for keeping their access data (particularly the password) confidential. If the User becomes aware that an unauthorized third party may have access to their password, they must immediately change their password and notify Art And Urn if there is any suspicion that the third party may misuse the password in any way.

The User undertakes to update their personal data provided during registration to ensure they are accurate, complete, and up to date.

3.2. Order

After logging into the Website, the User can place an order for the products advertised for sale on the Website. The User can obtain detailed information about the product’s features, price, name, or image by clicking on the product.

The user can select the product they wish to order and add it to their cart by clicking the “Add to Cart” button on the product details page. On the same page, the user can specify the quantity by entering the desired number. Adding products to the cart does not yet commit the user to a purchase or automatically register and forward the user’s order. To view the contents of the cart, the user should click the “Cart” menu item, located at the top right of the page next to the cart icon. On this page, the user can still modify the contents of the cart, as they have the option to delete a product by clicking the red X icon or change the product quantity by clicking the + or – buttons.

If the user no longer wishes to browse through products, they can start the order process by filling out the order form (hereinafter referred to as the Order Form) under the cart content. If the user has a coupon code or bonus, they can redeem it by entering the coupon code in the designated field and clicking “REDEEM COUPON.” Alternatively, the user can continue browsing the online store by clicking the back button in their browser. On the Order Form, the user must provide the necessary details for the order as outlined in section 3.1, including the delivery method. Depending on the chosen delivery method, the payment options available will vary, and these will be displayed next to the delivery method. If the user selects a delivery method with multiple payment options, they can choose their preferred payment method by clicking on the payment option and then clicking the “SEND ORDER” button on the page. By doing so, the user sends the order to Art And Urn, which constitutes a contractual offer. After the order is submitted, the system will notify the user of the order’s success, the order ID, and that they will receive an email confirming the order.

The user can check the status of their orders under the “My Orders” menu. This function is only available to registered users and can be accessed after logging in. Art And Urn will send an email notification about the order status.

Art And Urn reserves the right to reject a confirmed order, either partially or entirely, but only after consulting with the user. Art And Urn is not responsible for any changes to the product, due to technical issues, supplier changes, or other factors beyond our control, without prior notice.

3.3. Discounts and Coupons

Coupons provide discounts that can reduce the total purchase price. Coupons can be obtained through various promotions. When using a coupon, the coupon code should be entered in the small empty field below the cart content, and by clicking “REDEEM COUPON,” the coupon value will be automatically deducted from the total amount. Coupons cannot be exchanged for cash, and partial redemption is not possible.

3.4. Correction of Data Entry Errors

The user can correct any data entry errors at any stage of the order process, before submitting the order to Art And Urn. They can correct errors either in their own account (modifying user data) or on the order page (e.g., deleting a product from the cart by clicking the red X icon). Data entry errors may include incorrectly entered quantities (which can be adjusted using the + or – buttons), incorrect products added to the cart, or errors in the order data (e.g., shipping address).

3.5. Binding Offer and Confirmation

Upon receiving the user’s offer, Art And Urn will confirm it without delay, by email, no later than 48 hours after receiving the order. This confirmation email will include the user’s details provided during the purchase or registration (billing and shipping information), the order ID, the order date, the list of ordered items, quantities, the product price, shipping costs, and the total amount to be paid.

This confirmation email from Art And Urn is considered acceptance of the user’s offer, creating a valid contract between Art And Urn and the user.

The user is exempt from the binding offer if they do not receive the confirmation email from Art And Urn within 48 hours of submitting the order.

If the user notices an error in the details provided in the confirmation email, they must notify Art And Urn within 1 day to prevent the fulfillment of an unwanted order.

The order is considered an electronic contract, governed by the Civil Code of Hungary (2013 V. Act), the laws on electronic commerce services, and certain issues related to services in the information society (CVIII Act of 2001), and is subject to the detailed rules for consumer and business contracts as outlined in the Government Decree 45/2014 (II.26.) and the provisions of the European Parliament and Council Directive 2011/83/EU on consumer rights.

3.6. Payment

Cash on Delivery (Paying the courier upon receipt): If the product ordered on the website is delivered by MPL courier service, the user can pay the total order amount to the courier in cash upon receipt.

Bank Transfer in Advance: If the product ordered on the website is delivered by MPL courier service, the user can pay for the ordered products before they are delivered, via a bank transfer to the account provided in the confirmation email received after the order. In the case of advance payment, the order number must always be included in the note field. The user is only entitled to receive the products after the payment has been credited.

Online Credit Card Payment (OTP Simplepay): If this payment method is chosen, the payment is due during the order process. After the order is submitted, the user will be redirected to the payment provider’s page, where they can make the payment. The user is only entitled to receive the products after successful payment.

In the case of online credit card payment (OTP Simplepay), the user acknowledges that the personal data stored in the Art And Urn database (Schenopol Kft.) will be transferred to OTP Mobil Kft. (as the data processor). The details of the data processing can be found in the SimplePay Privacy Policy at: https://simplepay.hu/vasarlo-aff

3.7. Invoice

Art And Urn will provide the user with an invoice printed along with the product or before delivery as proof of payment for the ordered items.

3.8. Delivery

Orders placed on the website will be delivered via MPL courier service to the address provided by the user during the online ordering process.

The courier service delivers orders Monday to Friday, between 8:00 AM and 5:00 PM. If the user is not available at the specified address during this period, it is advisable to provide a shipping address where the user can definitely receive the order.

Tracking the Package and Delivery Process:

Art And Urn will notify the User of the current status of the package via email sent to the email address provided during registration.

If the User is not at the provided delivery address, the courier service will attempt delivery again the next day. If the second attempt is unsuccessful, the package will be returned to Art And Urn’s warehouse, and the order will be automatically canceled. The courier service will be provided with the User’s phone number so that the courier can contact the User before delivery or in case of any delivery issues. Once the courier service has taken possession of the package, the User will receive an email with a tracking number that can be used to track the package on the MPL website.

Track the Package: https://www.posta.hu/nyomkovetes/nyitooldal

The tracking number can also be obtained from Art And Urn’s customer service via email at info@artandurn.com.

MPL Courier Service Contact Information:

By accepting the package from the delivery person and signing the receipt document, the User acknowledges the quantity and quality of the product. After the courier leaves, Art And Urn will not accept any quantity or quality complaints. By signing the delivery receipt, the User acknowledges that the package received matches the order, both externally and in terms of content (i.e., the package is not incomplete, and the packaging or product is not damaged).

If the User notices any damage to the product or packaging at the time of receipt, a report should be made in the presence of the delivery person. If visible damage to the packaging or product occurred before the User took receipt of it, Art And Urn will provide a return at no charge. Art And Urn is not responsible for any damage discovered after receipt.

3.8.1. Shipping Costs:

Shipping within Hungary via MPL courier service costs 1,590 HUF.

Shipping costs within the European Union:

  • Shipping to the following countries costs 2,990 HUF: Slovakia, Slovenia, Austria, Czech Republic, Romania, Croatia, Poland, Germany, Belgium, Netherlands, Luxembourg, Liechtenstein**, Bulgaria, Switzerland**
  • Shipping to the following countries costs 5,990 HUF: Denmark, France, San Marino***, Vatican***, Italy, United Kingdom, Monaco, Ireland, Lithuania, Latvia, Spain, Sweden, Estonia, Turkey**, Malta, Norway**, Greece, Andorra**, Gibraltar***, Portugal, Finland, Cyprus

3.8.2. Shipping Deadline:

The majority of orders are shipped within 1 business day. Unless otherwise agreed upon with Art And Urn, the product must be delivered within thirty days following the conclusion of the contract.

If Art And Urn delays delivery, the User, if considered a consumer, has the right to set a replacement deadline. If Art And Urn fails to fulfill the order within the extended deadline, the consumer has the right to cancel the contract.

The consumer may cancel the contract without setting a new deadline if:

a) Art And Urn refuses to fulfill the contract; or

b) According to the agreement of the parties, or due to the nature of the service, the delivery should have occurred within the specified time frame and not at another time.

3.9. Product Price:

The price of the products is shown on the Webshop, including VAT and other public charges. The price does not include the cost of delivery.

The price of the products is listed in Hungarian Forints (HUF).

Right of Withdrawal:

The provisions in this section apply only to natural persons acting outside the scope of their profession, independent occupation, or business activity, who purchase, order, receive, use, or benefit from goods, as well as those addressed in commercial communications related to the goods (hereinafter referred to as “Consumer”).

4.1. The Consumer is entitled to the contract for the sale of goods.

a) the product,

b) in the case of multiple products, the last product delivered,

the Consumer has the right to withdraw from the contract within fourteen (14) days from the day of receipt by the Consumer or by a third party designated by the Consumer, other than the carrier, without providing any justification.

Art And Urn grants the User 30 days instead of the statutory 14-day withdrawal period, allowing the User to exercise their right of withdrawal.

The Consumer is entitled to exercise the right of withdrawal during the period between the conclusion of the contract and the day of receiving the product.

If the Consumer wishes to exercise the right of withdrawal, they must send a clear declaration of their intention to withdraw (by post, fax, or electronically) to Art And Urn using the contact details provided in point 1 of this Terms and Conditions. For this purpose, the Consumer may use the sample withdrawal form available via the following link: https://artandurn.com/letoltes/elallasi_nyilatkozat_minta.docx.

The Consumer exercises the right of withdrawal within the deadline if they send their withdrawal statement to Art And Urn before the expiry of the above-mentioned deadline.

In both cases, Art And Urn will promptly confirm the receipt of the Consumer’s withdrawal statement via email.

In the case of written withdrawal, the declaration will be considered timely if the Consumer sends it within 30 calendar days (even on the 30th calendar day) to Art And Urn.

When notifying by post, the date of posting will be considered; when notifying by email or fax, the time of sending the email or fax will be considered by Art And Urn for deadline calculations. The Consumer is advised to send the letter as a registered mail to provide reliable proof of the sending date.

In case of withdrawal, the Consumer must return the ordered product to the address listed in point 1 of this Terms and Conditions without undue delay, and in any case, within 14 days from the communication of their withdrawal. The deadline is considered met if the Consumer sends (posts or hands over to the courier they ordered) the product before the 14-day period expires.

If the product is not returned in its original packaging, the Consumer is obliged to carefully pack it to prevent damage.

The cost of returning the product to Art And Urn’s address is borne by the Consumer. Art And Urn is not able to accept packages sent by cash on delivery. The Consumer will not incur any other costs regarding the withdrawal other than the cost of returning the product.

If the Consumer withdraws from the contract, Art And Urn will reimburse all payments made by the Consumer, without undue delay, but no later than 14 days from the receipt of the Consumer’s withdrawal statement. This excludes any additional costs incurred due to the Consumer choosing a delivery method other than the cheapest standard shipping offered by Art And Urn. Art And Urn may withhold the reimbursement until it has received the product or the Consumer has provided proof that it was sent back: Art And Urn will consider the earlier date.

The Consumer is only liable for a decrease in the value of the product if the decrease was caused by handling the product in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the product.

The Consumer does not have the right to withdraw in the case of custom-made products that were made according to the Consumer’s instructions or explicitly tailored to the Consumer’s specifications.

WARRANTY

In the case of a consumer contract, it is presumed that any defect recognized by the consumer within twelve months after delivery existed at the time of delivery, unless this presumption is incompatible with the nature of the product or the defect. Therefore, in the first twelve months, Art And Urn must prove that the product sold to the consumer met the quality requirements set forth in the contract or by law at the time of delivery. After twelve months, the Consumer must prove that the product was defective.

5.1. Warranty

In the case of faulty performance by Art And Urn, the User may enforce warranty claims against Art And Urn. For consumer contracts, the User may enforce warranty claims within a two-year limitation period from the date of receipt for product defects that existed at the time of delivery. After the two-year limitation period, the User can no longer enforce warranty claims.

For non-consumer contracts, the entitled party may enforce warranty claims within a one-year limitation period from the date of receipt.

The User may request either repair or replacement, except when fulfilling the request would be impossible or would result in disproportionate additional costs for Art And Urn. If the User did not request or could not request repair or replacement, they may claim a reduction in the purchase price or repair the defect at Art And Urn’s expense, or have it repaired by someone else, or ultimately cancel the contract. Minor defects do not justify contract cancellation.

The User may switch from one warranty claim to another, but the cost of this transition must be borne by the User, unless the switch was justified or caused by Art And Urn.

The User must notify Art And Urn of the defect without undue delay, but no later than two months after discovering the defect.

The User may enforce their warranty claim directly with Art And Urn.

Within six months of the performance of the contract, there are no other conditions for enforcing the warranty claim, besides informing Art And Urn of the defect, as long as the User proves that the product was purchased from Art And Urn (by presenting the invoice or a copy of the invoice). In this case, Art And Urn will only be exempt from warranty if it can prove that the defect occurred after delivery to the User. If Art And Urn can prove that the defect was caused by the User, it is not obliged to accept the warranty claim. After six months from the performance, the User must prove that the defect existed at the time of delivery.

5.1. Warranty Claim

If the User asserts their warranty claim concerning a separable part of the product in relation to the identified defect, the warranty claim shall not be considered valid for the other parts of the product.

5.2. Product Warranty

In case of a defect in the product (movable item), the customer, who qualifies as a consumer, may assert either the right defined in section 5.1 or a product warranty claim at their discretion.

However, the User is not entitled to assert both a warranty claim and a product warranty claim simultaneously for the same defect. In the case of a successful product warranty claim, the User may assert a warranty claim for the replaced product or the repaired part against the manufacturer.

Under a product warranty claim, the User can only request the repair or replacement of the defective product, meaning there is no option for monetary compensation, price reduction, or withdrawal, as there is no contractual relationship between the manufacturer and the consumer. The User must prove the product defect when asserting a product warranty claim.

A product is considered defective if it does not meet the quality requirements applicable at the time of its market launch or if it lacks the characteristics stated in the description provided by the manufacturer.

The User may assert their product warranty claim within two years from the product’s launch date by the manufacturer. After this period, they lose this right. The User must inform the manufacturer of the defect without delay after its discovery. A defect reported within two months of its discovery must be considered to have been reported without delay. The consumer is responsible for any damages caused by the delay in reporting.

The User can assert their product warranty claim against the manufacturer or distributor (Art And Urn).

The manufacturer or distributor (Art And Urn) is only exempt from product warranty obligations if they can prove that:

  • The product was not manufactured or placed on the market within the scope of their business activity, or
  • The defect was not detectable at the time of the product’s release according to the state of science and technology, or
  • The defect in the product resulted from the application of laws or mandatory official regulations.

It is sufficient for the manufacturer or distributor (Art And Urn) to prove one of these reasons to be exempted from the product warranty obligation.

5.3. Guarantee

Regarding mandatory guarantees for specific durable consumer goods, the government decree 151/2003. (IX. 22.) on mandatory guarantees for durable consumer goods contains provisions. The decree applies only to new products sold within the framework of consumer contracts concluded in Hungary and listed in the annex of the decree.

For durable consumer goods listed in the annex, the warranty duration is aligned with the selling price as follows:

  • For a selling price of 10,000 HUF or more but less than 100,000 HUF, the warranty period is one year.
  • For a selling price exceeding 100,000 HUF but not exceeding 250,000 HUF, the warranty period is two years.
  • For a selling price exceeding 250,000 HUF, the warranty period is three years.

The warranty period begins on the day the product is handed over to the Consumer, or, if the installation is performed by Art And Urn or its representative, on the day of installation. Art And Urn will activate the warranty certificate when the User receives the product.

Under the warranty, the User has the same rights as outlined in section 5.1 regarding warranty claims.

The business is only exempt from its warranty obligations if it proves that the defect occurred after the completion of the contract.

However, the User is not entitled to assert both a warranty claim and a guarantee claim, or a product warranty and a guarantee claim simultaneously for the same defect. Notwithstanding these restrictions, the User is entitled to assert their rights from the guarantee independently of the rights defined in sections 5.1 and 5.2.

A defect is not covered under the guarantee if it occurs after the product has been handed over to the Consumer, such as in cases of:

  • Improper installation (except if performed by Art And Urn or its representative, or if improper installation is due to a defect in the user manual),
  • Misuse, disregard of the instructions in the user manual,
  • Improper storage, improper handling, damage,
  • Natural disasters or other external causes.

The consumer may switch to a different claim at their discretion. The User must pay for any costs arising from the change of claim, unless the change was caused by the Service Provider or was otherwise justified.

In case of doubt, Art And Urn will have the product examined by an expert. The purpose of the examination is to determine who is responsible for the product’s defect. If it is proven that the defect resulted from improper use, Art And Urn is not obligated to fulfill the warranty claim.

If the Consumer makes a replacement request due to a product defect within three working days from the purchase (installation), Art And Urn cannot claim disproportionate additional costs and must replace the product, provided the defect prevents proper use of the product.

The repair or replacement must be carried out within an appropriate timeframe, considering the product’s characteristics and the Consumer’s expected use. Art And Urn must aim to complete the repair or replacement within a maximum of fifteen days.

Only new parts can be used in the repair of the product.

The warranty period does not include the time during which the Consumer is unable to use the product properly. If the product or a part of the product is replaced or repaired, the warranty period for the replaced (repaired) product or part starts anew, and the warranty for any subsequent defect caused by the repair begins from that moment.

The costs related to fulfilling the warranty obligations are borne by Art And Urn.

For products that are fixed or weigh more than 10 kg, or are too large to be transported as carry-on luggage on public transport (except for vehicles), the repair must be done at the place of operation. If the repair cannot be performed on-site, Art And Urn will take care of disassembly, reinstallation, and transportation.

The warranty does not affect the Consumer’s rights arising from legislation, such as warranty or product liability claims.

In case of a consumer dispute, the Consumer may initiate the procedure of the conciliation body operating next to the county chambers of commerce and industry.

Warranty claims can be asserted directly at the service center indicated on the warranty card.

If the warranty card is not provided, the contract’s conclusion is considered proven if the Consumer presents a document proving payment, such as an invoice or receipt issued in accordance with the VAT law. In this case, rights arising from the warranty can be asserted with the payment proof.

The purchaser may optionally extend the warranty by an additional year for a gross price of 990 HUF. In this case, the rights listed above apply for an additional year from the date of purchase.

5.4. Assertion of Warranty and Guarantee Claims

The User can assert warranty and guarantee claims:

Address: Art And Urn
Email: info@artandurn.com

LEGAL REMEDIES

6.1. Complaint Handling Location, Time, and Method

The User can submit consumer complaints regarding the product or the activities of Art And Urn through the following contact details:

Mailing address: Art And Urn
Email address: info@artandurn.com

Art And Urn will, if possible, resolve verbal complaints immediately. If immediate resolution is not possible due to the nature of the complaint or if the User disagrees with the handling of the complaint, Art And Urn will record the complaint in a protocol, which will be kept for five years, along with the substantive response to the complaint.

In the case of verbal complaints communicated by phone or other electronic communication services, Art And Urn will send a copy of the protocol to the User, along with the substantive response, no later than at the same time.

In all other cases, Art And Urn will follow the rules for written complaints.

Art And Urn will respond substantively to written complaints within 30 days. The action in this regard is considered to be the mailing of the response.

If the complaint is rejected, Art And Urn will inform the User of the reasons for the rejection.

6.2. Other Legal Remedies

If a consumer dispute between Art And Urn and the User is not resolved during negotiations with Art And Urn, the following legal remedies are available to the User:

  • Filing a complaint with the consumer protection authority

  • Initiating proceedings with the conciliation board:

The business is obligated to cooperate in the conciliation board proceedings.

  • Initiating court proceedings

  • Starting a dispute via the online dispute resolution platform:

The European Commission has created a website where consumers can register to resolve disputes related to online purchases by completing a request form, avoiding court proceedings. This allows consumers to enforce their rights without being hindered, for example, by distance. If you wish to file a complaint about a product or service purchased online and do not want to go to court, you can use the online dispute resolution tool. On the platform, you and the trader you have a complaint against can jointly choose the dispute resolution body to handle the complaint. The online dispute resolution platform can be accessed here:

    https://webgate.ec.europa.eu/odr/main/?event=main.home.show&lng=HU

In the application of the rules regarding the Conciliation Board, a consumer is considered to be any civil organization, church, housing association, cooperative, or micro, small, and medium-sized enterprise that purchases, orders, receives, uses, or takes advantage of goods or is the intended recipient of commercial communication or offers related to goods.

UNILATERAL AMENDMENT OF THE GENERAL TERMS AND CONDITIONS

Art And Urn is entitled to unilaterally modify these General Terms and Conditions, with prior notification to the Users on the Website. The modified provisions will become effective upon the first use of the Website by the User after their entry into force, and they will apply to orders placed after the modification.

RETAINED TITLE

The product remains the property of Art And Urn until the full purchase price is paid. If the product comes into the possession of the User before the full payment of the purchase price, for any reason, the User is liable to Art And Urn for any damages that cannot be claimed from anyone.

Date of Entry into Force of These General Terms and Conditions: [2023-12-03]
